ความไม่รู้กฎหมายไม่เป็นข้อแก้ตัว (ละติน : ignorantia juris non excusat ) เป็นหลักกฎหมายที่ถือว่า บุคคลผู้ไม่รู้กฎหมายไม่อาจพ้นความรับผิดจากการฝ่าฝืนกฎหมาย เพียงเพราะเขาไม่รู้ถึงเนื้อหากฎหมายนั้น
ประเทศที่ใช้กฎหมายยุโรปโดยมีประเพณีจากกฎหมายโรมันอาจใช้ภาษิตของแอริสตอเติล ซึ่งแปลเป็นภาษาละตินว่า nemo censetur ignorare legem (จะถือว่ามีคนไม่รู้กฎหมายไม่ได้) หรือ ignorantia iuris nocet (ความไม่รู้กฎหมายเป็นสิ่งอันตราย) ด้วย
ตำรากฎหมายสากลได้จำแนกความไม่รู้กฎหมายออกเป็นสองประเภท อย่างแรกคือความไม่รู้โดยแท้ (simple ignorance) หมายถึงความไม่รู้ว่าข้อกฎหมายนั้นมีอยู่ อย่างที่สองคือความไม่รู้เพราะสำคัญผิด (mistake ignorance) หมายถึงเข้าใจว่าข้อกฎหมายนั้นมีอยู่แต่ความจริงกลับไม่มีอยู่ หรือเป็นการเข้าใจกฎหมายอย่างผิด ๆ
ระบบกฎหมายไม่คำนึงถึงจิตสำนึกของผู้กระทำว่าทราบหรือไม่ว่าการกระทำนั้นถือเป็นเป็นความผิดตามกฎหมาย มิเช่นนั้นแล้วผู้ที่ต้องรับผิดก็จะมีเพียงผู้รู้กฎหมาย ซึ่งขัดต่อหลักความศักดิ์สิทธิ์ของกฎหมายที่ต้องการใช้บังคับแก่ทุกคนโดยไม่มีใครปฏิเสธได้
