รัฐธรรมนูญแห่งสาธารณรัฐอิตาลี (Costituzione della Repubblica Italiana) ผ่านความเห็นชอบจากสภาร่างรัฐธรรมนูญเมื่อวันที่ 22 ธันวาคม ค.ศ. 1947 โดยมีเสียงเห็นชอบ 453 เสียง และคัดค้าน 62 เสียง ตัวบทกฎหมาย ซึ่งมีการแก้ไขแล้ว 13 ครั้ง ได้รับการประกาศในราชกิจจานุเบกษาเล่มพิเศษฉบับที่ 298 วันที่ 27 ธันวาคม ค.ศ. 1947 สภาร่างรัฐธรรมนูญได้รับเลือกตั้งมาโดยสิทธิออกเสียงเลือกตั้งทั่วไปเมื่อวันที่ 2 มิถุนายน ค.ศ. 1946 ขณะเดียวกับการลงประชามติว่าด้วยการสละราชสมบัติของพระมหากษัตริย์ รัฐธรรมนูญมีผลใช้บังคับเมื่อวันที่ 1 มกราคม ค.ศ. 1948
รัฐธรรมนูญอิตาลียาว 139 มาตรา (มี 4 มาตราที่ถูกยกเลิกไปภายหลัง) และจำแนกได้เป็นสามส่วนหลัก คือ หลักการพื้นฐาน (มาตรา 1-12), ส่วนแรก ว่าด้วยสิทธิและหน้าที่ของพลเมือง (มาตรา 13-54), และสามที่สอง ว่าด้วยการจัดระเบียบสาธารณรัฐ (55-139) ตามด้วยบทบัญญัติเฉพาะกาลและบทบัญญัติสุดท้าย 18 ข้อ
