ดินแดนที่ไม่มีเจ้าของ (ละติน: terra nullius) เป็นศัพท์ซึ่งมีที่มาจากกฎหมายโรมัน หมายความว่า ดินแดนที่ไม่เป็นของผู้หนึ่งผู้ใด หรือดินแดนไร้ผู้ครอบครอง (no mans' land) ศัพท์นี้ใช้ในกฎหมายระหว่างประเทศแผนกคดีเมือง หมายความว่า ดินแดนที่ไม่เคยตกอยู่ในอำนาจอธิปไตยของรัฐใด ๆ หรือซึ่งไม่มีรัฏฐาธิปัตย์ใด ๆ เคยสละอำนาจอธิปไตยไม่ว่าโดยตรงหรือโดยอ้อม

อำนาจอธิปไตยเหนือดินแดนที่ไม่มีเจ้าของนั้นอาจได้มาโดยการยึดครอง แต่ในบางกรณี การยึดครองดินแดนเช่นนั้นอาจเป็นการละเมิดกฎหมายระหว่างประเทศหรือสนธิสัญญาได้
