ศาลศาสนาสเปน

ในเชิงนิรุกติศาสตร์ ศาลศาสนา (Inquisition) มีที่มาจากภาษาละติน inquisitĭo กับ inquisitiōnis ซึ่งมีความหมายว่า การกระทำและผลของการตรวจสอบ ศาลศาสนามีชื่อทางการว่า กระบวนการไต่สวนผู้ผิดต่อจารีต (Inquisitio Haereticae Pravitatis)

ศาลศาสนาในประเทศสเปนก่อตั้งขึ้นในปี ค.ศ. 1478 พระสันตะปาปาซิกซ์ตัสที่ 4 ได้อนุญาตให้กษัตริย์เฟอร์ดินันด์และราชินีอิซาเบลก่อตั้งศาลศาสนา เพื่อลงโทษ “คนคริสต์ใหม่” (New Christian) หรือ “กอนเบร์โซ” (Converso) ที่ยังคงนับถือศาสนาเดิมและประพฤตินอกรีต ต่อมาในปี ค.ศ. 1488 มีคำสั่งให้จัดตั้งสภาศาลศาสนาซึ่งมีหน้าที่ประสานงานระหว่างศาลศาสนาในแต่ละพื้นที่ พิจารณาคดีอุทธรณ์ และพิจารณาคดีของเจ้าหน้าที่ของศาลศาสนาที่กระทำผิดในคดีนอกรีต

การทำงานของศาลศาสนาจะประกอบไปด้วย ผู้พิพากษา อัยการ ตำรวจ เจ้าพนักงานพิทักษ์ทรัพย์ เสมียนศาล ผู้แจ้งข่าว และ แพทย์ กระบวนทำงานของศาลศาสนาจะเริ่มต้นเมื่อมีผู้เข้ามาฟ้องร้องว่ามีการกระทำนอกรีต อัยการจะเป็นผู้พิจารณาว่าเข้าข่ายหรือไม่ หากใช่ผู้พิพากษาจะสั่งจับกุมผู้ถูกกล่าวหาและนำไปคุมจังในคุก ต่อมาศาลจะดำเนินการริบทรัพย์สินและจัดทำบัญชีอย่างละเอียด ศาลจะยึดทรัพย์ไว้จนกว่าคดีจะตัดสิน ในระหว่างที่อยู่ในคุก ศาลก็จะนำทรัพย์สินที่ยึดไปจำหน่ายเพื่อนำเงินมาเป็นค่าใช้จ่ายของผู้ถูกกล่าวหา ผู้ถูกกล่าวหาจะถูกแยกขังเดี่ยวและห้ามคุยกับผู้ถูกคุมขังคนอื่น ๆ อีกทั้งยังไม่ให้ญาติมาเยี่ยมจนว่าจะตัดสินคดีเสร็จสิ้น

ในกระบวนการไต่สวน ศาลจะเชื่อว่าผู้ถูกกล่าวหากระทำความผิดไว้ก่อนและเป็นหน้าที่ของผู้ถูกกล่าวหาที่จะต้องแก้ต่างเพื่อยืนยันความบริสุทธิ์ของตน อย่างไรก็ตาม ศาลจะไม่แจ้งข้อกล่าวหาแก่ผู้ถูกกล่าวหา ผู้ถูกกล่าวหาจะต้องทบทวนตนเอง ในระหว่างนี้ศาลจะเตือนเป็นระยะ ๆ จะนวน 3 ครั้ง เมื่อครบแล้วแต่ผู้ถูกกล่าวหายังไม่สารภาพ ศาลจึงจะแจ้งข้อกล่าวหา นอกจากนี้ศาลจะแสดงหลักฐานการกระทำผิดให้ผู้ถูกล่าวหารับทราบ แต่ศาลจะปกปิดผยาน ศาลศาสนาจะใช้การทรมานเพื่อให้ผู้ถูกกล่าวหารับสารภาพ ผู้พิพากษาต้องอยู่ร่วมด้วยในระหว่างนี้ โดยมีเสมียนศาลเป็นผู้จดบันทึกเหตุการณ์อย่างละเอียดและมีแพทย์คอยตรวจดูสภาพร่างกายว่ายังทนไหมหรือไม่ ศาลศาสนาจะทำงานหนักมากเนื่องจากมีกอนเบร์โซเพิ่มขึ้นเป็นจำนวนมาก จึงทำให้การตัดสินคดีล่าช้าจนผู้ถูกกล่าวหาบางคนเสียชีวิตก่อนที่จะได้รับการไต่สวน

การติดสินลงโทษตั้งแต่เบาไปหาหนัก ในกรณีที่ความผิดไม่ร้ายแรง ผู้กระทำผิดจะต้องสาบานว่าจะไม่ทำอีกหลังจากนั้นจะถูกตัดสินโทษทางกาย ซึ่งมีตั้งแต่สวมเสื้อซานเบนิโต (Sanbenito) ถูกปรับ หรือ ถูกเนรเทศ สำหรับการทำผิดร้ายแรง หลังจากสาบานแล้วจะอาจถูกลงโทษโดยการเฆี่ยน จำคุก หรือเป็นทาสฝีพายหลวง การตัดสินโทษที่ร้ายแรงที่สุดคือการประหารชีวิตโดยการเผาทั้งเป็น แต่บางครั้งถ้าผู้กระทำผิดแสดงความสำนึกผิดก็จะถูกรัดคอให้เสียชีวิตขณะกำลังจะจุดไฟเผา นอกจากนี้ยังมีการจัดพิธีอ่านคำพิพากษาของผู้กระทำผิดจำนวนมากที่จัตุรัสกลางเมือง เรียกพิธีนี้ว่า “เอาโต เด เฟ” (Auto de fe) ซึ่งเป็นการแสดงให้เห็นว่าผู้กระทำความผิดได้รับการอภัยและกลับสู่อ้อมกอดของคริสตจักร

อย่างไรก็ตาม ศาลศาสนาถูกประท้วงหลายต่อหลายครั้งในเวลาต่อมา การประท้วงครั้งสำคัญในอาณาจักรอารากอนเกิดที่เมืองเตรูเอล (Teruel) ในปี ค.ศ. 1484 ระหว่างประชาชนในเมืองและบาทหลวง กษัตริย์เฟอร์ดินันด์ผู้มีอำนาจสูงสุดเลือกที่จะปกป้องบาทหลวงเพื่อรักษาศาลศาสนาไว้ การประท้วงครั้งสำคัญอีกหนึ่งเหตุการณ์เกิดขึ้นที่เมืองซาราโกซา มีการลอบสังหารบาทหลวงผู้พิพากษาคนสำคัญคนหนึ่งโดยมีผู้มีส่วนร่วมทั้งหมด 8 คน ฆาตกรคนหนึ่งถูกฆ่าอย่างโหดเหี้ยม สร้างความหวาดกลัวให้ผู้มีส่วนร่วมคนอื่นอย่างมาก เหตุการณ์นำไปสู่การกวาดล้างกอนเบร์โซที่ต่อต้านศาสนาทั้งหมด
