การประท้วงในฮ่องกง พ.ศ. 2562–2563

การประท้วงต่อต้านร่างรัฐบัญญัติส่งผู้ร้ายข้ามแดนฮ่องกง พ.ศ. 2562–2563 เป็นการเดินขบวนในฮ่องกงและนครอื่น ๆ ทั่วโลกเพื่อเรียกร้องให้ถอน "ร่างรัฐบัญญัติกฎหมายผู้หนีคดีและความช่วยเหลือร่วมกันทางกฎหมายในคดีอาญา (แก้ไขเพิ่มเติม) ค.ศ. 2019" (Fugitive Offenders and Mutual Legal Assistance in Criminal Matters Legislation (Amendment) Bill 2019) ที่รัฐบาลฮ่องกงเสนอ เพราะเกรงว่า ร่างกฎหมายดังกล่าวจะทำให้ฮ่องกงเปิดรับความครอบงำจากกฎหมายของจีนแผ่นดินใหญ่ ซึ่งจะทำให้ชาวฮ่องกงตกอยู่ใต้ระบบกฎหมายอื่นที่นอกเหนือไปจากของตน

ประชาคมทางกฎหมายและประชาชนทั่วไปเริ่มประท้วงหลายรูปแบบในฮ่องกง ซึ่งรวมถึงการประท้วงครั้งแรกเมื่อวันที่ 9 มิถุนายน พ.ศ. 2562 ของแนวร่วมสิทธิมนุษยชนพลเมือง (Civil Human Rights Front) ที่มีผู้มาสมทบถึง 1.03 ล้านคนตามการประเมินของแนวร่วมเอง และได้รับการนำเสนออย่างมากในสื่อมวลชน ต่อมา ชาวฮ่องกงโพ้นทะเลและผู้คนในท้องถิ่นอื่นก็พากันประท้วงในพื้นที่ของตน

แม้มีการเดินขบวนอย่างกว้างขวาง รัฐบาลฮ่องกงยืนยันจะผ่านร่างกฎหมายนี้ให้ได้ โดยกล่าวว่า จำเป็นต้องมีกฎหมายนี้อย่างเร่งด่วน จะได้อุด "ช่องว่าง" ในกฎหมาย เดิมกำหนดจะพิจารณาวาระที่สองในวันที่ 12 มิถุนายน พ.ศ. 2562 แต่เลื่อนออกไปก่อนเพราะการประท้วง การประชุมที่กำหนดจะจัดในวันที่ 13 มิถุนายน พ.ศ. 2562 ก็เลื่อนเช่นกัน

วันที่ 15 มิถุนายน พ.ศ. 2562 แคร์รี หลั่ม ผู้บริหารสูงสุดของเกาะฮ่องกงแถลงว่า ได้ให้เลื่อนพิจารณาร่างกฎหมายนี้อย่างไม่มีกำหนด แต่เน้นย้ำว่า เป็นเพียงเลื่อน ไม่ใช่ถอน ทำให้มีผู้ฆ่าตัวตายประท้วงที่ลานไท่กู่ (Pacific Place) ในอีกไม่กี่ชั่วโมงต่อมา ครั้นวันรุ่งขึ้น มีการเดินขบวนใหญ่อีกครั้งเพื่อกดดันให้ถอนร่างกฎหมายและให้ผู้บริหารฮ่องกงลาออกจากตำแหน่ง

การประท้วงดำเนินตลอดมาทั้งฤดูร้อน และมักทวีเป็นการปะทะกันอย่างรุนแรงระหว่างตำรวจ, ผู้ปฏิบัติการเชิงรุก, กลุ่มอั้งยี่ (triad) ที่หนุนจีนแผ่นดินใหญ่, และชาวบ้านในกว่า 20 ท้องที่ทั่วทั้งภูมิภาค เมื่อการชุมนุมคืบหน้าไปนั้น นอกจากผู้ชุมนุมจะเรียกร้องให้มีการสอบสวนอย่างเป็นอิสระเรื่องที่ตำรวจใช้ความรุนแรง เรียกร้องให้ปล่อยผู้ชุมนุมที่จับตัวไป และเรียกร้องให้รัฐบาลเลิกถือว่าการประท้วงเป็นการก่อจลาจล เป็นต้นแล้ว ผู้ชุมนุมยังเรียกร้องเพิ่มเติมให้ประชาชนสามารถเลือกตั้งผู้บริหารและคณะผู้บริหารได้โดยตรง ซึ่งเคยเป็นชนวนการประท้วงเมื่อ พ.ศ. 2557

หลั่มชะลอร่างกฎหมายส่งผู้ร้ายข้ามแดนในวันที่ 15 มิถุนายน แต่ยังไม่ยอมให้สัญญาว่าจะถอนร่างฯ จนวันที่ 4 กันยายน อย่างไรก็ดี เธอยังปฏิเสธยอมรับข้อเรียกร้องอีกสี่ข้อที่เหลือ กล่าวคือ ให้ตั้งคณะกรรมการอิสระสอบสวนความรุนแรงของตำรวจ การปล่อยตัวผู้ประท้วงที่ถูกจับกุม การเลิกระบุการประท้วงของทางการว่าเป็น "การจลาจล" และให้เธอลาออกจากตำแหน่งและให้มีสิทธิออกเสียงเลือกตั้งทั่วไปสำหรับสภานิติบัญญัติและผู้บริหารสูงสุด

วันที่ 1 ตุลาคม มีการเดินขบวนขนานใหญ่ซึ่งตรงกับวันครบรอบ 70 ปีการสถาปนาสาธารณรัฐประชาชนจีน มีผู้ประท้วงนักศึกษาอายุ 18 ปีถูกตำรวจยิงด้วยกระสุนจริง ผู้บริหารสูงสุดในสภาใช้ข้อบังคับระเบียบฉุกเฉินในวันที่ 4 ตุลาคมเพื่อใช้กฎหมายห้ามสวมหน้ากาก

ภูมิหลัง

ใน พ.ศ. 2530 กลุ่มพิเศษว่าด้วยกฎหมาย ในคณะกรรมการที่ปรึกษากฎหมายพื้นฐานของฮ่องกง (Special Group on Law of the Hong Kong Basic Law Consultative Committee) เสนอให้ใช้หลักดินแดน (territorial principle) ระงับข้อพิพาททางเขตอำนาจของฮ่องกงกับจีนแผ่นดินใหญ่ เพื่อที่ใครก็ตามที่กระทำความผิด ไม่ว่าจะอาศัยในฮ่องกงหรือจีนแผ่นดินใหญ่ จะต้องถูกดำเนินคดี ณ ที่เกิดเหตุ ต่อมาใน พ.ศ. 2541 หลี่ จู้หมิง (Martin Lee) นักกฎหมายสายประชาธิปไตยซึ่งอยู่ในกลุ่มพิเศษดังกล่าว แถลงในที่ประชุมสภานิติบัญญัติว่า รัฐบาลฮ่องกงควรตั้งมั่นในหลักดินแดน และต้องเริ่มจัดให้มีการส่งผู้ร้ายข้ามแดนกับจีนโดยไม่ชักช้า

ในเดือนกุมภาพันธ์ พ.ศ. 2562 รัฐบาลฮ่องกงเสนอ "ร่างรัฐบัญญัติกฎหมายผู้หนีคดีและความช่วยเหลือร่วมกันทางกฎหมายในคดีอาญา (แก้ไขเพิ่มเติม) ค.ศ. 2019" เพื่อแก้ไขเพิ่มเติม "รัฐกำหนดผู้หนีคดี" (Fugitive Offenders Ordinance: Cap. 503) ในประเด็นเกี่ยวกับการจัดให้มีการมอบตัวเป็นกรณีพิเศษ (special surrender arrangements) และแก้ไขเพิ่มเติม "รัฐกำหนดความช่วยเหลือร่วมกันทางกฎหมายในคดีอาญา" (Mutual Legal Assistance in Criminal Matters Ordinance: Cap. 525) เพื่อที่ฮ่องกงจะสามารถจัดให้มีความช่วยเหลือร่วมกันทางกฎหมายกับสถานที่ใด ๆ ภายนอกฮ่องกง การเสนอร่างกฎหมายดังกล่าวเพื่อให้ฮ่องกงสามารถขอให้ไต้หวันมอบตัวชายผู้ต้องสงสัยฆ่าคนในไต้หวัน แต่กลไกที่ร่างขึ้นมิใช่เพื่อกรณีไต้หวันเท่านั้น ยังสามารถใช้แก่จีนแผ่นดินใหญ่และมาเก๊าได้ด้วยซึ่งเป็นกรณีที่ยังไม่อยู่ในขอบเขตของกฎหมายปัจจุบัน

วัตถุประสงค์

เดิมทีผู้ประท้วงเรียกร้องให้ถอนร่างรัฐบัญญัติอย่างเดียว แต่เมื่อตำรวจเพิ่มกลวิธีตอบโต้ผู้ชุมนุมเมื่อวันที่ 12 มิถุนายน พ.ศ. 2562 และมีประกาศเมื่อวันที่ 15 มิถุนายน พ.ศ. 2562 ว่า เลื่อนพิจารณาร่างรัฐบัญญัติไปอย่างไม่มีกำหนดแล้ว วัตถุประสงค์ของผู้ประท้วงก็กลายเป็นการบรรลุข้อเรียกร้องห้าประการดังต่อไปนี้

ข้อเรียกร้อง เหตุผล
ถอนร่างรัฐบัญญัติออกจากกระบวนการนิติบัญญัติไปโดยสิ้นเชิง แม้มีประกาศว่าเลื่อนพิจารณาไม่มีกำหนด แต่จะกลับมาพิจารณาเมื่อใดก็ได้ และปัจจุบัน อยู่ในขั้นตอน "รอจัดวาระสองใหม่" นอกจากนี้ สมาชิกสภานิติบัญญัติบางคน เช่น เจี่ยง ลี่-ยฺหวิน (Ann Chiang) ก็ระบุว่า เมื่อการประท้วงยุติแล้ว จะกลับมาดำเนินกระบวนการนิติบัญญัติใหม่
เลิกถือว่าการประท้วงเป็นการก่อจลาจล เดิมรัฐบาลใช้คำว่า "จลาจล" เรียกการประท้วงเมื่อวันที่ 12 มิถุนายน พ.ศ. 2562 ภายหลัง แก้เป็นว่า มีผู้ประท้วงบางคนที่ก่อจลาจล แต่ผู้ประท้วงก็คัดค้านว่า ไม่เคยมีใครก่อจลาจลในวันนั้น
ปล่อยและเลิกเอาผิดผู้ประท้วงที่จับตัวไป ผู้ประท้วงเห็นว่า การจับตัวผู้ประท้วงนั้นมีแรงจูงใจทางการเมือง โดยตั้งคำถามว่า การที่ตำรวจบุกเข้าโรงพยาบาลไปจับผู้ประท้วง โดยอาศัยข้อมูลลับทางการแพทย์ในการติดตามตัว ซึ่งเป็นการละเมิดความเป็นส่วนตัวของผู้ป่วยนั้น ชอบด้วยกฎหมายหรือไม่
ตั้งกรรมการอิสระมาสอบสวนการกระทำและการใช้กำลังของตำรวจในระหว่างการประท้วง กลุ่มพลเมืองเห็นว่า ไม่มีเหตุสมควรที่ตำรวจจะต้องใช้กำลังถึงขั้นที่ใช้ในวันที่ 12 มิถุนายน พ.ศ. 2562 โดยเฉพาะกับผู้ประท้วงที่ไม่ได้กระทำอะไรผิดเลย นอกจากนี้ มองว่า การที่ตำรวจสกัดและค้นตัวผู้สัญจรไปมาใกล้ที่ประท้วงโดยไม่มีเหตุควรสงสัยอันใดนั้น เป็นการใช้อำนาจมิชอบ อนึ่ง ยังมองว่า การที่เจ้าหน้าที่บางยังไม่แสดงบัตรประจำตัวหรือเอกสารอนุญาต แม้มีระเบียบตำรวจให้ต้องทำเช่นนั้น ก็เป็นการฝ่าฝืนความรับผิดชอบ ส่วนที่เรียกร้องให้ตั้งกรรมการอิสระ เพราะเห็นว่า กรรมการที่มีอยู่ไม่เป็นอิสระ หากแต่ทำงานตามที่ตำรวจประสาน
ให้แคร์รี หลั่ม ผู้บริหารสูงสุดของฮ่องกง ลาออก และให้ประชาชนมีสิทธิโดยทั่วกันในการเลือกตั้งสมาชิกสภานิติบัญญัติและผู้บริหารสูงสุด ปัจจุบัน ผู้บริหารสูงสุดมาจากการสรรหาของคณะกรรมการการเลือกตั้งที่มีกรรมการ 1,200 คน ส่วนสมาชิกสภานิติบัญญัติ 30 คนนั้นมาจากผู้มีสิทธิเลือกตั้งบางกลุ่มที่เป็นตัวแทนภาคส่วนต่าง ๆ ในวงการเศรษฐกิจเท่านั้น

การประท้วงในวันที่ 31 มีนาคม พ.ศ. 2562

แนวร่วมสิทธิมนุษยชนพลเมืองจัดประท้วงครั้งแรกในวันที่ 31 มีนาคม พ.ศ. 2562 โดยเริ่มเดินจากถนนหลูยา (Luard Road) ตรงสนามเด็กเล่นซิวตุ้น (Southorn Playground) ไปจบที่จัตุรัสพลเมือง (Civic Square) ผู้ประท้วงร้องว่า "ฮ่องกงจะกลายเป็นคุกมืดเพราะส่งผู้ร้ายข้ามแดนกับจีน" (with extradition to the mainland, Hong Kong becomes a dark prison) และ "หยุดกฎหมายชั่ว" (stop the evil law)

หลิน หรงจี (Lam Wing-kee) เจ้าของร้านหนังสือถงหลัววาน (Causeway Bay Books) ที่หายตัวไปใน พ.ศ. 2558 พร้อมกับเพื่อน ปรากฏว่า มาร่วมจัดประท้วงครั้งนี้พร้อมกับผู้สนับสนุนนิยมประชาธิปไตยคนอื่น ๆ ด้วย แต่หลังจากนั้นก็ออกจากฮ่องกง เพราะเกรงตนเองไม่ปลอดภัย

แนวร่วมระบุว่า มีคนกว่า 12,000 คนมาร่วมเดินขบวน แต่ตำรวจฮ่องกงประเมินว่า มีเพียง 5,200 คน แนวร่วมระบุด้วยว่า จะประท้วงอีกถ้ารัฐบาลยังไม่ล้มเลิกร่างกฎหมายฉบับนี้

การประท้วงในวันที่ 28 เมษายน พ.ศ. 2562

วันที่ 28 เมษายน พ.ศ. 2562 คนกว่า 130,000 คน (ตามที่ผู้จัดประท้วงระบุ ส่วนตำรวจประเมินว่า 22,800 คน) ร่วมเดินขบวนประท้วงร่างกฎหมายนี้อีกครั้ง โดยเริ่มเดินจากร้านหนังสือถงหลัววานไปยังสภานิติบัญญัติเป็นระยะทาง 2.2 กิโลเมตร และกินเวลา 4 ชั่วโมง เฉิน ฮ่าวหฺวัน (Figo Chan Ho-hang) รองผู้นำการประชุม (vice-convenor) ของแนวร่วมสิทธิมนุษยชนพลเมือง กล่าวว่า จะยกระดับการประท้วงถ้ารัฐบาลยังไม่ถอนร่างกฎหมาย

หนึ่งวันให้หลัง หลิน เจิ้ง เยฺว่เอ๋อ (Carrie Lam) ผู้บริหารสูงสุดของฮ่องกง แสดงความมั่นใจว่า ร่างกฎหมายนี้จะผ่านในที่สุด ซึ่งสมาชิกสภานิติบัญญัติต้องทำให้ได้ก่อนช่วงพักร้อน แม้ว่าชายผู้ต้องสงสัยฆ่าคนในไต้หวันจะถูกพิพากษาจำคุก 29 เดือนไปก่อนหน้าแล้ว ซึ่งทำให้ไม่มีเหตุผลรองรับความจำเป็นเร่งด่วนของร่างกฎหมายนี้อีกก็ตาม

การประท้วงในวันที่ 6 มิถุนายน พ.ศ. 2562

วันที่ 6 มิถุนายน พ.ศ. 2562 มีการประท้วงชนิดที่เกิดขึ้นไม่บ่อยครั้ง คือ นักกฎหมายชาวฮ่องกงกว่า 3,000 คน ซึ่งนับเป็นหนึ่งในสี่ของนักกฎหมายทั้งหมดในฮ่องกง พากันเดินขบวนต่อต้านร่างกฎหมายนี้ โดยสวมชุดดำ เดินจากศาลอุทธรณ์ไปยังศูนย์ราชการ แล้วหยุดยืนอยู่หน้าศูนย์ราชการ มองขึ้นไปข้างบน และยืนสงบนิ่งไว้อาลัยให้สามนาที

ผู้จัดการประท้วงครั้งนี้ คือ กัว หรงเคิง (Dennis Kwok) สมาชิกสภานิติบัญญัติแบบแบ่งเขต และนับเป็นครั้งที่ห้าที่นักกฎหมายประท้วงในฮ่องกง

หลี่ เจียเชา (John Lee) เลขานุการฝ่ายความมั่นคง แสดงความเห็นว่า นักกฎหมายที่ประท้วงนั้นไม่เข้าใจร่างกฎหมายอย่างถ่องแท้

การประท้วงในวันที่ 31 สิงหาคม พ.ศ. 2562

การประท้วงเริ่มมีการจุดไฟเผาและปาระเบิดขวด มีรายงานว่ามีผู้ได้รับบาดเจ็บ 46 รายที่ต้องนำส่งโรงพยาบาล

การประท้วงในฮ่องกง พ.ศ. 2562 ส่วนใหญ่ได้รับอธิบายว่า "ไร้ผู้นำ" ไม่มีกลุ่มหรือพรรคการเมืองใดอ้างว่าเป็นผู้นำขบวนการ ส่วนใหญ่รับบทบาทสนับสนุนมากกว่า เช่น ยื่นขอใช้สถานที่ (Letters of No Objection) จากตำรวจหรือไกล่เกลี่ยข้อพิพาทระหว่างผู้ประท้วงและเจ้าพนักงานตำรวจ ผู้ประท้วงโดยทั่วไปใช้ LIHKG ฟอรัมออนไลน์คล้ายกับเรดดิต และเทเลแกรม ซึ่งเป็นบริการส่งสารเข้ารหัสต้นจนจบคล้ายกับวอตส์แอพ เพื่อสื่อสารและระดมสมองหาความคิดสำหรับการประท้วงและตัดสินใจร่วมกัน
