รัฐบาล คือองค์การที่มีอำนาจในการออกและบังคับใช้กฎหมาย สำหรับดินแดนหนึ่งๆ นิยามที่ชัดเจนของรัฐบาลนั้นมีอยู่หลายนิยาม ในกรณีทั่วไป รัฐบาล คือผู้ที่มีอำนาจในการปกครอง กล่าวคือมีอำนาจในการบริหารจัดการเหนือพื้นที่ใดๆ หรือเหนือกลุ่มคน รัฐบาลตรงกับคำภาษาอังกฤษว่า government ซึ่งมีความหมายสองนัยยะ นัยยะแรกหมายถึงกิจกรรมการปกครอง และอีกความหมายหนึ่งคือคณะบุคคลที่มีอำนาจในการปกครอง

ระบอบการปกครอง (form of government) หมายถึง สถาบันทางการเมืองซึ่งรัฐบาลของรัฐได้จัดตั้งขึ้นเพื่อใช้อำนาจในการปกครองประเทศ คำนี้ยังนิยามรวมไปถึงรัฐบาลที่ไม่ประสบความสำเร็จในการใช้อำนาจปกครองประเทศด้วย

เจตจำนงหรือวัตถุประสงค์ของรัฐ

เจตจำนงแห่งรัฐ (Will of the state) เป็นเกณฑ์หนึ่งในทางรัฐศาสตร์ที่อธิบายถึงเป้าหมายของระบอบการปกครองในแต่ละรูปแบบ นับตั้งแต่การเป็นชุมชนทางการเมืองที่เป็นระบบจนพัฒนามาสู่การเป็นรัฐสมัยใหม่ เมื่อพิจารณาจากพัฒนาการของรัฐสมัยใหม่นับตั้งแต่สมัยกลางเป็นต้นมา เจตจำนงหรือวัตถุประสงค์ของรัฐในแต่ละยุคเกิดขึ้นจากบริบททางสังคม ปรัชญา อุดมการณ์ทางการเมือง ศาสนา ตลอดจนโลกทัศน์ของคนแต่ละยุคสมัยแตกต่างกัน ซึ่งแต่ละแนวคิดจะเน้นความสำคัญของปัจเจกบุคคลในระดับความเข้มข้นแตกต่างกัน ในยุคคลาสสิค และยุคกลางเจตจำนงแห่งรัฐจะมีความมีเสถียรภาพอันมีเป้าหมายในการสนับสนุนสถาบันกษัตริย์ และสถาบันศาสนา ส่วนในยุคสมัยใหม่เจตจำนงแห่งรัฐจะมีความเป็นพลวัตรและปรับตัวให้เข้ากับยุคสมัยที่เปลี่ยนแปลงไปผ่านการแสดงเจตจำนงผ่านการเลือกตั้งของประชาชน โดยกระบวนการสร้างรัฐสมัยใหม่นี้ต้องใช้ระบบกฎหมายสนับสนุนจึงจะดำเนินไปได้อย่างมีประสิทธิภาพตามแนวคิดความสูงสุดแห่งอำนาจอธิปไตยที่เป็นของประชาชนที่ทำให้รัฐสามารถบัญญัติกฎหมายได้อย่างไม่มีขอบเขตจำกัด อันเป็นการสามารถสะท้อนเจตจำนงทางการเมืองของประชาชน และมีความเป็นพลวัตรต่อเนื่องไปอยู่เสมอ
