สิทธิมนุษยชน

สิทธิมนุษยชน (อังกฤษ: human rights) เป็นหลักทางศีลธรรมหรือจารีต ซึ่งอธิบายมาตรฐานตายตัวของพฤติกรรมมนุษย์ และได้รับการคุ้มครองสม่ำเสมอเป็นสิทธิทางกฎหมายในกฎหมายท้องถิ่นและกฎหมายระหว่างประเทศ ปกติเข้าใจว่าเป็นสิทธิพื้นฐานที่ไม่โอนให้กันได้ "ซึ่งบุคคลมีสิทธิในตัวเพียงเพราะผู้นั้นเป็นมนุษย์" และซึ่ง "มีอยู่ในมนุษย์ทุกคน" โดยไม่คำนึงถึงชาติ สถานที่ ภาษา ศาสนา ชาติพันธุ์กำเนิดหรือสถานภาพอื่นใด สิทธิมนุษยชนใช้ได้ทุกที่ทุกเวลาในแง่ที่เป็นสากล และสมภาคในแง่ที่เหมือนกับสำหรับทุกคน สิทธิดังกล่าวต้องการความร่วมรู้สึกและหลักนิติธรรม และกำหนดพันธะต่อบุคคลให้เคารพสิทธิมนุษยชนของผู้อื่น สิทธิดังกล่าวไม่ควรถูกพรากไปยกเว้นอันเป็นผลของกระบวนการทางกฎหมายที่ยึดพฤติการณ์แวดล้อมจำเพาะ ตัวอย่างเช่น สิทธิมนุษยชนอาจรวมเสรีภาพจากการจำคุกโดยมิชอบด้วยกฎหมาย การทรมานและการประหารชีวิต

ปรัชญาตะวันตกเรื่องสิทธิมนุษยชนที่เก่าแก่ที่สุดสำนักหนึ่งมีว่าสิทธิมนุษยชนเป็นผลลัพธ์ของกฎหมายธรรมชาติ ที่มาจากเหตุผลทางปรัชญาหรือศาสนาที่แตกต่างกัน ทฤษฎีอื่น ๆ มีว่าสิทธิมนุษยชนเป็นการประมวลพฤติกรรมที่มีศีลธรรมของมนุษย์ ซึ่งเป็นผลลัพธ์ทางสังคมของมนุษย์ที่พัฒนามาจากกระบวนการวิวัฒนาการทางชีววิทยาและสังคม

มโนทัศน์

สากลนิยมกับสัมพัทธนิยมทางวัฒนธรรม

ปฏิญญาสากลว่าด้วยสิทธิมนุษยชนระบุไว้ว่าสิทธิมนุษยชนใช้กับมนุษย์ทุกคนโดยเสมอกัน ไม่ว่าอยู่ที่ใด รัฐใด มีเชื้อชาติหรือวัฒนธรรมใดก็ตาม แต่ผู้สนับสนุนสัมพัทธนิยมเสนอว่าสิทธิมนุษยชนไม่ใช่สิ่งสากล และขัดแย้งกับบางวัฒนธรรมตลอดจนคุกคามการอยู่รอดของวัฒนธรรมเหล่านั้น บางคนอธิบายสากลนิยมว่าเป็นจักรวรรดินิยมทางวัฒนธรรม เศรษฐกิจหรือการเมือง โดยเฉพาะอย่างยิ่งมโนทัศน์สิทธิมนุษยชนมักอ้างว่ามีรากเหง้ามาจากทัศนะทางการเมืองแบบเสรีนิยม ซึ่งแม้ว่าโดยทั่วไปเป็นที่ยอมรับในทวีปยุโรป ญี่ปุ่นและอเมริกาเหนือ แต่มิได้เป็นมาตรฐานที่อื่น นอกจากนี้ยังมีการพาดพิงถึงนักคิดสิทธิมนุษยชนที่ทรงอิทธิพลบางคน เช่น จอห์น ล็อก และจอห์น สจวต มิล ว่าทุกคนเป็นชาวตะวันตกและบางคนยังพัวพันกับการบริหารจักรวรรดิเองเสียด้วย

ลี กวน ยิว อดีตนายกรัฐมนตรีสิงคโปร์ และมหาเธร์ โมฮัมหมัด อดีตนายกรัฐมนตรีมาเลเซีย อ้างในคริสต์ทศวรรษ 1990 ว่าค่านิยมแบบเอเชียแตกต่างจากค่านิยมตะวันตกมาก และมีสำนึกเรื่องความจงรักภักดีและการยอมสละเสรีภาพส่วนบุคคลเพื่อให้สังคมมีเสถียรภาพและมั่งคั่ง ฉะนั้นรัฐบาลอำนาจนิยมจึงเหมาะสมกับทวีปเอเชียมากกว่าประชาธิปไตย
